Mental Health Parity

Your Child's RightsLaw Library

The Mental Health Parity Act (MHPA) of 1996 requires health insurance plans that offer mental health benefits to set limetime dollar limits equivalent to limits for medical/surgical benefits.

It does not, however, require all plans to offer mental health benfits. Limits for substance abuse or chemical dependency benefits are not included.

New provisions in the act go into effect July 1, 2010. For more information on the changes, watch the CNN video below.

To learn more about MHPA, go the Department of Health and Human Services informational page.

Some states have their own mental health parity laws. Some states parity laws cover substance abuse benefits, as well as treatment for mental illness. To learn more, go to this page from the National Council of State Legislatures.
